Ten years later, secondary liability for trademark infringement continues to be a point of tension between trademark owners and e-commerce platforms. This panel invites the key players who represented both sides in the seminal case, as well as amicus brief writers, to revisit the decision and reflect on the development of the secondary liability doctrine over the last ten years. The panel concludes with a discussion of the recently proposed bi-partisan SHOP SAFE act legislation that aims to provide additional protection to trademark owners that Tiffany failed to do. This online event is approved for 1.0 transitional/non-transitional New York State CLE credits in the category “Areas of Professional Practice.” You must attend the “live” program in order to receive CLE credits.
