As Secretary of Homeland Security, Johnson’s responsibilities included counterterrorism, cybersecurity, aviation security, border security, port security, maritime security, protection of our national leaders, the detection of chemical, biological and nuclear threats to the homeland, and response to natural disasters.Prior to becoming Secretary of Homeland Security, Johnson was appointed by President Obama to be General Counsel of the Department of Defense (2009-2012) and appointed by President Clinton to be General Counsel of the Department of the Air Force (1998-2001). Ten years later, secondary liability for trademark infringement continues to be a point of tension between trademark owners and e-commerce platforms. This panel invites the key players who represented both sides in the seminal case, as well as amicus brief writers, to revisit the decision and reflect on the development of the secondary liability doctrine over the last ten years. The panel concludes with a discussion of the recently proposed bi-partisan SHOP SAFE act legislation that aims to provide additional protection to trademark owners that Tiffany failed to do.
