The metaverse allows consumers to engage with others, attend events, and purchase goods for their avatars, such as digital clothing and accessories. Brands are facing a new challenge– how to protect their trademarks in the metaverse. Recently, we have seen a few companies apply for trademark applications for use of their trademarks for “store services featuring virtual clothing and accessories for use in online virtual worlds” and “for online, non-downloadable virtual clothing and accessories for use in virtual environments.” This event will discuss which companies have applied for trademarks in the metaverse, the need for it, how to apply for it (i.e., International Classes and goods/services descriptions), and what protections brands currently have absent a trademark (i.e., how the current law translates to metaverse use).
