October 18, 2017 New York Daily News - The New York Daily News interviewed 10 legal experts - including Cardozo Law's Professor Jonathan Oberman - about Manhattan District Attorney Cy Vance Jr.'s decision to not charge Harvey Weinstein after Ambra Battilana Guttierez accused him of sexually assaulting her. Most of the experts say there was enough evidence to file charges. At the time, Cy Vance Jr. argued there wasn't enough evidence to prove intent.
In the article, Oberman called the DA's “intent” rationale “patently self-serving.” He said a jury would have found the required intent in this case.
